Welcome to Tennis Courterly, a tournament management service operated in Portland, Oregon. These Terms of Service ("Terms") govern your use of our website, registration system, and related services (collectively, the "Service"). By creating an account, registering for a tournament, or otherwise using the Service, you agree to these Terms.
By accessing the Service you agree to these Terms and our Privacy Policy. We may update these Terms from time to time. We indicate changes by updating the version number and effective date at the bottom of this page. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
You must be at least 18 years of age (or have the consent and electronic signature of a parent or legal guardian) to register for a tournament. You represent that all information you provide is accurate, current, and complete, and that you will keep it updated.
When you register for a tournament we create a player profile associated with your email address. You are responsible for maintaining the accuracy of your profile and for any activity that occurs through your registrations. Some flows — including "magic link" sign-in and partner profile updates — authenticate you via single-use tokens delivered by email; keep those emails private, since anyone with the link can update your profile or claim your registration.
Entry fees are charged at the time of registration via Stripe, our payment processor. Each tournament publishes its own refund policy at checkout — read it before paying. Refunds, when issued, are processed back to the original payment method and may take five to ten business days to settle. Discount codes and promotional rates are non-transferable and may be limited per registration.
You agree to follow United States Tennis Association (USTA) rules of play, the on-site instructions of the tournament director, and applicable laws. The tournament director may suspend or disqualify any participant for unsportsmanlike conduct, abusive behavior, intoxication, or other violations of these rules. Withdrawals after the published deadline may forfeit some or all of the entry fee per the tournament''s refund policy.
By creating a registration you agree to receive transactional emails related to your tournaments — confirmations, scheduling, refunds, partner updates, and waitlist notices. If you separately opt in to SMS via the consent checkbox on the registration form, you also agree to receive recurring automated text messages about tournament registration, scheduling, and match notifications at the number you provided. Consent to SMS is not a condition of registration. Message frequency varies (typically five to fifteen per tournament). Message and data rates may apply. Reply STOP to opt out of SMS at any time; reply HELP for assistance. SMS opt-out does not affect transactional emails — to manage email preferences, contact support.
The Service, including its software, design, and content (excluding user-submitted content), is owned by Tennis Courterly or its licensors and is protected by copyright, trademark, and other laws. You may not copy, reproduce, distribute, or create derivative works without our prior written permission.
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure, or that defects will be corrected. Tournament play involves inherent physical risk; see the participant waiver you accept at registration for additional release terms.
To the maximum extent permitted by law, Tennis Courterly and its operators, employees, contractors, and venue partners are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service or participation in a tournament. Our total cumulative liability to you for any claim arising from these Terms or the Service shall not exceed the total fees you paid us in the twelve months preceding the event giving rise to the claim.
You agree to indemnify, defend, and hold harmless Tennis Courterly, its operators, employees, contractors, and venue partners from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys'' fees) arising from your use of the Service, your participation in a tournament, your violation of these Terms, or your violation of any third-party right.
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive termination — intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.
These Terms are governed by the laws of the State of Oregon, without regard to its conflict-of-law principles. Any dispute arising out of or related to these Terms or the Service shall be resolved in the state or federal courts located in Multnomah County, Oregon, and you consent to the personal jurisdiction of those courts. Nothing in this section prevents either party from seeking injunctive relief in any court of competent jurisdiction.
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.
